Employment Class Action Cases

FedEx Ground Class Action
We recently settled a misclassification class action on behalf of Oregon drivers for FedEx Ground for $15.45 million.  In 2014, the Ninth Circuit ruled as a matter of law that the drivers were employees, not independent contractors as contended by FedEx Ground.  The ruling made way for drivers to proceed to trial to recover overtime and improperly deducted business expenses, which led to the settlement.  

Rite Aid Class Action
In 2013, Stoll Berne settled a class action lawsuit against Rite Aid Corporation on behalf of assistant store manager employees who were wrongfully classified as overtime-exempt.  Under the terms of the settlement, Rite aid will pay $20.9 million to a nationwide class of about 4,016 members.  The complaints alleged that assistant store managers were wrongfully classified as exempt from overtime pay because they performed work that required little skill and no capital investment, and their primary duties didn't include managing either an assigned store or any department or subdivision thereof.  Rite Aid denied liability.  Rite Aid, however, no longer classifies assistant store managers at its stores as exempt from overtime pay.

Bottomley Class Action
We obtained a settlement in a wage and hour class in Oregon state court on behalf of over 300 Latino employees that made Christmas wreaths at an Oregon facility.  Workers received full reimbursement of overtime plus attorney fees.

Stahlbush Farms Class Action
Stoll Berne settled a class action lawsuit against Stahlbush Island Farms, Inc. on behalf of current and former non-farm Stahlbush employees who were wrongfully classified as exempt and not paid overtime due by Stahlbush. The settlement paid qualified current and former employees overtime pay, penalty wages, and interest.

Portland School District - Custodian Class Action

Smurfit Employee Class Action
The Smurfit case was a class action on behalf of the employees at a Smurfit plant in McMinnville, Oregon who were not timely paid when Smurfit sold the plant.
